insurance adjuster…?

i got into an accident a few weeks ago, the other party was at fault. I am trying to deal with their insurance but the insurance adjuster says they don't have a current contact number for their client and insists i go through my insurance to collect the damages to my vehicle, loss wages, rental car and personal injury. This sounds like a manipulation tactic. what should i do?"
I live in California.

    I have never dealt with someone else's insurance company with regard to an accident, no matter who is at fault. I have ALWAYS used my insurance carrier to settle the details.

  3. H-m-m, if you reside in a no-fault state, the adjuster is correct. Tell me what state you live in and I'll try to let you know what to do next.

    California, oh great… Sorry. This is what I found:

    Conclusion: Call your insurance company.

  4. You have to realize there is nobody at that insurance company that works for you, or is employed to protect or serve you. However, there are people at your insurance company that offer those services to you, and you have paid for that service in your premium. I suggest you use the services you have paid for.

    Are you sure the other party is at fault? Did you make a police report? Do you have witnesses? If you said yes to all the above, go ahead and open a claim under your policy so you can at least get your damages paid. Ask your claims adjuster to waive your deductible. They will subrogate against the other party to pay back the damages paid out. If you were injured, and it turns out the other party lied and doesn't have insurance, then open a uninsured motorist claim for your medical issues. Just make sure you have ID on the at fault party so your adjuster can go after them. If your damages are over 750.00 (I think) your adjuster should report it in to the DMV and the at fault party will loose their drivers license if he's not insured. It's not really a manipulation tactic, the other insurance company does need to speak with their insured to get his side of the story.
