The police can get a court order to get your phone records to see if you were on a cel phone at the time of the Wreck its done everyday, if you are on a phone at the time your in a wreck, you can and will be at fault
I am not sure I understand what you mean. When your go to obtain auto insurance coverage, the application that your agent completes will ask for your phone number. This is standard on any application. They do not have the right, however, to give out your phone number to any third party.
