Do I have to keep my husband on my health insurance?

He has only been gone for three months. We are not even legally separated because he has done nothing about it.
Since there is no legal separation, do I still have to keep the a– on my health insurance?
Is your answer based on legal information? I'm not looking for an opinion.

No, go and change your policy.

It depends on what kind of employer you are working for.
If it is a non-employer sponsored plan that you bought on your own, you can not only have him taken off the policy but also ask to have them re-rate you and give you a refund from the time he left to now.
Usually under an employer sponsored plan, you also have the right to convert it under certain circumstances.
Seperation may qualify as the 'unusual life event' clause that lets you change your policy outside your annual open windown.
However, there are certain negotiated labor agreements under the federal Taft-Hartley Act that are made between companies and unions. If you have coverage under those policies you have to take the policy offered if it has your husband on it and you can't make any changes or even refuse it if you have other coverage.
