Why would a fraudulent dog bite claim have an effect on the homeowner's ability to get insurance?

although the lease stated "no pets",my tenant acquired an aggressive dog. A visiting friend teased the dog and was nipped. Blood was drawn, EMT's arrived. We have pic's of the kid playing tennis and golf a few days later. My insurance company never paid a cent, yet i pay more for coverage because it is flagged as having an "incident" on my history. Is this legal? Can i do this to my archenemy? ;) Seriously, isn't this a slippery slope? I'm guilty of nothing, the kid is guilty of fraud, yet i can't get discount insurance. if it matters, the house is in NY.
i have called several companies (all the way from the big, national guys to the local ones) and it seems to be the rule. i did submit pictures of the kid,so they didn't pay anything. but it still is considered an incident. it's not just a ny thing; it must be national, according to the companies.

  1. Yeah, it's legal - although slimy. That's a crap company you have - I would suggest switching.

    And since you were flagged you can sue the renter for the increase.

    NY Sucks dude. I also live here and own a Rottweiller. The biggest baby you will ever meet, however NY has deemed Them, Pit Bulls, and several otherdogs as dangerous and the insurance (if you can get it for these dogs) is outrageous. You should have taken pics and video of the kid playing tennis and golf andsent it into the insurance company. They may have been able to do something. Contact a Lawyer, maybe they can give you advice, go with an insurance lawyer, hewill know betterthan anyone.

    oh yeah it's legal, while you may not have committed any of the actions that resulted in the accident and then fraudulent action, you are still liable for your tenants, and it's your responsibility to enforce the lease. as such, they now see a history where you could be a higher risk insured because they don't know what else you might not keep from happening. you have to understand with insurance companies, it's all a calculation of expected risks based on the information they have, and the premium is adjusted based on that information.

  8. There are certainly a lot of details like that to take into consideration. That is a great point to bring up. I offer the thoughts above as general inspiration but clearly there are questions like the one you bring up where the most important thing will be working in honest good faith. I don?t know if best practices have emerged around things like that, but I am sure that your job is clearly identified as a fair game.
